Request for support and financial resources for the international legal defence of the Mapuche Nation before the International Court of Justice in The Hague.

Dear friends and social organisations,
We are writing to you on behalf of the Mapuche people, in order to request your support and financial resources to defend our rights and our territory.
In response to various requests made by ancestral authorities of the Mapuche Nation and as a result of the systematic repression they have suffered since 1881; as a result of the military invasion of the Chilean and Argentinean State in their ancestral territories, with the consequent genocide, territorial dispossession, European colonisation, depredation of nature, extractivism and ecocide, which continues to be a common practice to this day, the ‘COMMISSION OF KIMCHE AND DEFENDERS OF WALLMAPU’ (CKDDW) has been created in 2021 as a technical/legal working commission of the MAPUCHE HUMAN RIGHTS COMMISSION (MHRC).
Territorial dispossession has always been accompanied by state repression, with intimidation, illegal imprisonment with police set-ups, improper and excessive use of police and military force, torture and even killings and forced disappearances, which is sufficiently documented by the reports of different local and international human rights organisations.
On the 7th of March 2023, CKDDW filed a petition for international arbitration requesting the State of Chile to respect the territorial limits of the Mapuche Nation, agreed with the Spanish Crown in 1641 through the Treaty of Quilín, and subsequently with the State of Chile in 1825 through the Treaty of Tapihue, instruments that are still in force and that clearly establish the Mapuche ancestral territory and the terms of the relationship between the native people and the State of Chile. To date, the State of Chile has not pronounced itself either favourably or unfavourably, ignoring the request for arbitration, thus failing to comply with the international right to petition.
The State of Chile continues to violate these international treaties, in addition to the American Convention on Human Rights, Convention 169 of the INTERNATIONAL LABOUR ORGANISATION (ILO), as well as other international instruments designed to protect human rights, the rights of indigenous peoples and the environment (United Nations Declaration on the Rights of Indigenous Peoples).
On the contrary, the current government has increased repression of the Mapuche people through the application of the State of Constitutional Exception, which has been maintained without interruption since 16 May 2022. This allows it to imprison Mapuche community members, suspending their ancestral and territorial rights, applying the Anti-Terrorism Law and the Internal Security Law to Mapuche authorities in trials with faceless witnesses, imposing exemplary sentences without direct evidence or solid proof, based exclusively on circumstantial expressions and evidence.
On the other hand, the Chilean state has enacted and published new laws that apply especially to the Mapuche people (Nain Retamal Law or ‘trigger-happy law’, Usurpation Law, Intelligence Law), which leads to repeated raids on Mapuche communities with violent attacks on children, the elderly and women; an increase of Mapuche political prisoners in pre-trial detention without trial or evidence or long sentences for racist acts. To date, hundreds of Mapuche political prisoners remain incarcerated with the application of these new laws.
We still have a lot to do. We need your support to carry out new legal actions in the international arena and to cover the associated costs, for the restitution of the Mapuche ancestral territory (Wallmapu) and to put a definitive end to the dispossession and violations of human rights and the destruction of the environment against our People.

Estimados amigos y organizaciones sociales,
Nos dirigimos a ustedes en representación del pueblo mapuche, con el fin de solicitar su apoyo y recursos económico para defender nuestros derechos y territorio.
Respondiendo a diversas peticiones realizadas por autoridades ancestrales del Pueblo Nación Mapuche y a raíz de la sistemática represión que ha sufrido desde 1881; producto de la invasión militar del Estado chileno y argentino en sus territorios ancestrales, con el consecuente genocidio, despojo territorial, colonización europea, depredación de la naturaleza, extractivismo y ecocidio, que continúa siendo una práctica habitual hasta la presente fecha, se ha creado la “COMISIÓN DE KIMCHE Y DEFENSORES DE WALLMAPU” (CKDDW )como una Comisión técnica/jurídica de trabajo de la MAPUCHE HUMAN RIGHTS COMMISSION (MHRC) (2021)
El despojo territorial ha ido siempre acompañado de represión estatal, con amedrentamiento, encarcelamiento ilegal con montajes policiales, uso indebido y excesivo de la fuerza policial y militar, tortura e incluso asesinados y desaparición forzada, lo cual se encuentra suficientemente documentado por los informes de diferentes organismos de derechos humanos locales e internacionales.
CKDDW presentó el 7 de marzo de 2023 una petición de arbitraje internacional requiriendo al Estado de Chile el respeto de los límites territoriales del Pueblo Nación Mapuche, acordados con la Corona española en 1641 mediante el Tratado de Quilín, y posteriormente con el Estado de Chile en 1825 mediante el Tratado de Tapihue, instrumentos que se encuentran vigentes y que establecen claramente cuál es el territorio ancestral mapuche y los términos de la relación de este pueblo originario con el Estado de Chile. Hasta la fecha, el Estado de Chile no se ha pronunciado ni en sentido favorable ni desfavorable, ignorando la petición de arbitraje, incumpliendo con ello el derecho internacional de petición.
El Estado de Chile continúa infringiendo estos tratados internacionales, además de la Convención Americana de Derechos Humanos, el Convenio 169 de la ORGANIZACIÓN INTERNACITONAL DEL TRABAJO (OIT), además de otros instrumentos internacionales destinados a proteger los derechos humanos, los derechos de los pueblos originarios y el medio ambiente (Declaración de las Naciones Unidad sobre los Derechos de los Pueblos Indígena).
Muy por el contrario, el gobierno actual ha incrementado la represión al pueblo mapuche mediante la aplicación del Estado de Excepción Constitucional, que se ha mantenido sin interrupción desde el 16 de mayo de 2022. Ello le permite encarcelar a comuneros mapuche, suspendiendo sus derechos ancestrales y territoriales, aplicando la Ley Antiterrorista y Ley de Seguridad Interior a autoridades mapuche en juicios con testigos sin rostro, imponiendo condenas a penas ejemplares sin pruebas directas ni indicios sólidos, basadas exclusivamente en expresiones y pruebas circunstanciales.
Por otra parte, el Estado chileno ha promulgado y publicado nuevas leyes que se aplican especialmente al pueblo mapuche (Ley Naín Retamal o “ley de gatillo fácil”, Ley de usurpación, Ley de Inteligencia), lo que conlleva allanamientos reiterados a las comunidades mapuche con ataques violentos a los niños, ancianos y mujeres; un incremento de presos políticos mapuche en prisión preventiva sin juicios ni pruebas o largas condenas por hechos racistas. A la fecha se mantienen encarcelados a centenares de presos políticos mapuche con la aplicación de estas nuevas leyes.
Nos queda mucho por hacer. Necesitamos de tu apoyo para realizar nuevas acciones legales en el ámbito internacional y cubrir los gastos asociados, para la restitución del territorio ancestral mapuche (Wallmapu) y acabar definitivamente con el despojo y las violaciones a los derechos humanos y la destrucción del medioambiente en contra de nuestro Pueblo.
